  • Trump Declares National Emergency At Southern Border

Just posted on One America News:

President Trump said the U.S. is confronting a crisis at home, while declaring a national emergency over the issues at the border.

During a speech at the White House Friday, the president said the U.S. must handle what he described as the national security crisis at our southern border. He said he isn’t taking the action to fulfill a campaign promise, but rather because the country needs it.

The president said there’s an invasion of drugs, gangs and people coming into our country, and by signing the national emergency he is doing his part to try and stop it.
    Well done, Mr. President.

TOTALLY stupid move. What he gets by with opens a door for all future POTUS to do the same. NOT at all good nor is it needed.

No, the totally stupid move is that the Democrats are opposed to doing anything about illegal immigration. They are opposed to a secure border, be it barriers like a wall, or direct enforcement. Instead, they talk about a "Virtual wall." That is, a wall that doesn't exist in reality.
They were trying in this latest bill to limit ICE bed space to a point where even serious criminals couldn't be detained and would have to be released. They are cheering that illegal immigrants are suing for reparations from the US government.
They champion sanctuary cities and locations that flaunt federal law and openly oppose federal law enforcement.

Now the Democrats and Left will no doubt sue over this. They'll likely shop judges and go to the 9th Circuit to get a judgement against Trump. I'd expect them to go in front of an Obama appointed judge too. This ruling will likely be overturned on appeal, or it will go to the Supreme Court where it gets overturned.

Trump has a perfectly reasonable argument that illegal immigration is a national crisis that needs to be dealt with. If I were on his legal team I'd point out that groups with an agenda to bring down the US government, along with radical Leftist terrorists are in part, or whole, organizing the so-called "Caravans" and moving more people than would otherwise come for purposes of illegally entering the US in whole or part. Yes, Pueblos sin Fronteras is such a group. The Libre party is such a group.

If anything, the Left and Democrats really don't have a leg to stand on here.

          And the 'emergency' is exactly...what?
We are not now that strength which in old days
Moved earth and heaven; that which we are we are; One equal temper of heroic hearts
Made weak by time and fate but strong in will
To strive to seek to find and not to yield.

And Trump's action here, besides making up a national emergency, is unconstitutional. Anything to do with funding is Congress business not the executive.

It is violation of Article I, Section 7: 'All bills for raising revenue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other Bills.'

Nothing here about the executive branch being able to generate revenue for what they want to do. The money that Trump wants to reallocate to the vanity wall has to be done by Congress. Some of the money has been allocated to the Department of Defense by Congress and Trump has no right to use it for anything he wants. It doesn't work that way. Congress has the power of the purse, as set up by the Founders, not the executive branch.

And it should be noted that the majority of the people in the country do not support the wall.

                You are dead flat wrong.

The National Emergency Act of 1976 (50 USC § 1605– - 1651) gave the President power to declare a national emergency and push funding into resolving it. If Congress disagrees, then they can, by joint resolution signed by the President end the proclamation, or by super-majority can override the President's actions. It is the President's prerogative under section II of the Constitution to declare a national emergency, and it is Congress's right to override that proclamation by the legislative process. The checks and balances are present.

The Democrats haven't got a leg to stand on.

A logical fallacy in that this is a variant of appeal to popularity.

Presented to make an irrelevant point, hence why the graph is a logical fallacy.

I thought that the number of EOs CNN attributes to BO seemed pretty low, so looked further.

Perhaps I am reading CNN's graph wrong or out of context, but according to Snopes BO signed 275 EOs during his 2 terms.

So, either CNN using using a time frame that is not disclosed on the graph or they are lying.

That said, the number of EOs isn't as significant as the kind of EOs signed.

It's cherry picked data. Note the "October 13" date at the top. CNN selected a portion of each President's tenure to get the result they wanted.
