    if someone really beat the crap out of a robber, in self defense, , I'd never find them guilty

    Anyone can 'plan' to sue anyone. Will he get someone to take his case and file it? Doubt it. Wake me when he actually does so. Otherwise his mother is blowing hot air to a reporter.

      ..lawyers can be and are immoral ...I remember the North Hollywood Shootout where the robbers fired automatic weapons at everything and everyone.
      ..12 police and 8 civilians injured...one family sued for the robber bleeding to death....wiki says hung jury!!!

        They want money. This case has no chance for money. Sure they take case on contingency, but they expect to have a chance to collect. Unless this family pays cash up front, they'll not get a lawyer.

              True, but he could file suit himself.
              There are plenty of guys in prison who know how to draft a complaint. They couldn't represent him, but they can guide him.
              Filing suit is sometimes a form of entertainment to the convict.
              It isn't like he has a whole lot else to do and a suit like this might result in his being brought into the court room a couple times.

                More likely, and the way I'd play it defending against one is file some motions for dismissal as a nuisance suit and maybe pay a liar... err... lawyer to file a few motions that will cost the plaintiff cash to counter.
                Since inmates have a hard time filing as indigent now they have to come up with the cash to make the replies. Better, if you do a number of these he will probably miss some of the filing deadlines and that will get the case dismissed too.

                    In Illinois it isn't that hard to get filing fees waived and the prisons have to provide some resources for inmates to handle their own litigation. I don't know how far this goes but from what I have seen the prisons are pretty accommodating.


                    If the inmate's case gets dismissed he really hasn't lost anything and may have gotten a few field trips away from his cell.

                        Correct. And unfortunately if (likely when) he does this, it will cost the family of the actual victim cash money to file for it to be beaten.

                        If they're smart they'll get Summary Judgement dismissing the case with prejudice, so that the criminal cannot file suit in this matter again.

                        But still it costs. We had an arrestee attack one of our detention officers several years back, broke his nose IIRC. He was stopped by being tased by another officer. He filed suit claiming that he had been tased repeatedly and excessively (he was tased 3 times until they got him restrained)....it was false but it still cost money to beat the suit in court.....

                          CE, while this is true of many of those ridiculous cases, enough of them are taken on contingency because they are often settled out of court. Why, because the payout is cheaper for the defendant then going to court to fight those ridiculous claims. It's gravy train money for those TV lawyers. (Feiger, Sam, Lee, etc...)

                          This expensive abuse of the court system will only end once a Loser Pays law get passed. And, you know what the chances of that ever happening.

                            I think a loser pays system does more harm than good.
                            Under such a system the huge corporations would end up being almost immune from suit because so many people would decide that their valid claims weren't worth the risk of being saddled with millions of dollars in the "winner's" defense costs.
                            So such a system would chase away the valid claims along with the frivolous ones to the benefit of the people who could spend millions defending themselves. The courts would become closed to the poor.

                            I think a better system would be to put more pressure on Judges to award fees in cases of frivolous litigation.

                              This. Finland has loser pays system which means that people are afraid to go to court even if they have good chance of winning. Court costs are simply too large so taking risk is not worth it. Lawyers use it to their advantage when extorting people. Copyright trolls straight out threaten you with court costs if you don't pay settlement offer. In their settlement letter they use court cases they won as an example. In one they originally demanded 8000 euros it got lowered in court to 600 euros but defendant has pay their and his own costs which are over 50 000 euros. So people end up paying even if aren't guilty because they can't afford to take risk.
