  • KY county clerk refuses to issue gay marriage licenses

    I've been following this case where a county clerk disobeyed orders to issue gay marriage licenses, even a judge's order won't get her to do it. She's willing to go to jail and pay hefty fines, but she's going to stand by her beliefs. She's lucky to be in the deep south, where most agree with her beliefs. She is an elected official and it will require the Legislature to impeach her. This is highly unlikely in such a conservative state.

    MOREHEAD, Ky. (AP) - Invoking "God's authority," a county clerk denied marriage licenses to gay couples again Tuesday in direct defiance of the federal courts, and vowed not to resign, even under the pressure of steep fines or jail.

    SCOTUS has ruled against her already. She either needs to comply or be removed. If she can't do her job correctly she ahould have the common sense to quit instead of turning this into a payday for lawyers.

      There's a certain process to follow to get her removed. It is highly unlikely the Kentucky Legislature will do so.

        I would like to hear what she feels about divorce, since she's in her 4th marriage.

          The same should be said for all the people that DID issue such licenses back when it was illegal. There was an incident like that around here about a year ago and the official responsible was never punished in spite of the fact that she was breaking state law and issuing fraudulent marriage licenses. Selective justice at it's finest.

          On the plus side she's being taken down for a BUNCH of other highly corrupt things she did but still.

            What you don't understand is that there is no common sense involved here, she is an elected official by a local electorate and if she hasn't committed a felony she can not be removed from office by anyone other the electorate, marriage laws are State Laws according to our Constitution and SCOTUS has no say so.

              She drew attention to herself by violating the law, just as this Kentucky gal has drawn attention to herself. The feds may or may not get her for contempt of court, but I’d bet they will be looking at her taxes real close and probably her election campaign funding, and whatever else they can think of.

                She is violating Kentucky state law that says County Clerks SHALL issue licenses. Goggle NRA and "shall issue" to get a better understanding on that phrase and its importance.

                  The case itself has only been ruled on by the district Judge. He granted a temporary stay of his own order so she could appeal for a permanent stay that would last through the entire appeal process. The Appeals Court turned down that emergency stay. It is that request that went to the SCOTUS. That request, for a Stay, is what was turned down.

                  Now the case needs to be formally filed at the Apeales Court, that will be take time. So we are back to the District Judge and his original ruling against her. She and her deputy Clerks have been ordered to appear Thursday before the District Judge. She will be asked to present a case as to why she should not be held in contempt of the Court. She has no answer.

                        She might, however the couples lawyers have filed for the contempt but ask the Judge not to jail her. Her $80k job will not keep her from losing most of her money. Her fault, she can avoid it simply by delegating the task to a subordinate, but she refuses to do that. By the way she is refusing to issue any licenses, gay or straight.

                            Pres, KY is anything but but DEEP SOUTH. Southern, maybe, Border State Historically.

                              She's breaking the law, pure and simple.

                              If she cannot in good conscience do her job, then she should resign.

                              I do think, though, that this is more about prejudice than religious conviction, but that just me being cynical.
