  • Federal Court Blocks Obama/Illegals Again

    A federal appeals court refused Tuesday to allow the implementation, for now, of President Obama's executive action that could shield from deportation as many as 5 million illegal immigrants.
    The U.S. Justice Department had asked the 5th U.S. Circuit Court of Appeals to reverse U.S. District Judge Andrew Hanen's earlier decision temporarily halting the administration's plan. Hanen issued the temporary hold in February, after 26 states filed a lawsuit alleging Obama's action was unconstitutional.
    Two out of the three judges on a court panel, though, voted Tuesday to deny the government's request, as the underlying case is argued.
    The majority opinion reasoned that lifting the temporary hold -- known in judicial parlance as issuing a "stay" -- could cause serious problems for states should they ultimately win their challenge. It said the states have shown that "issuance of the stay will substantially injure" them.
    It continued: "A stay would enable DAPA beneficiaries to apply for driver's licenses and other benefits, and it would be difficult for the states to retract those benefits or recoup their costs even if they won on the merits. That is particularly true in light of the district court's findings regarding the large number of potential beneficiaries, including at least 500,000 in Texas alone."

    I wonder how this ruling will affect the DACA (Deferred Action for Childhood Arrivals) program. Congress de-funded it in 2013 but it continues to run because it is funded almost entirely by application fees ($465). It does not rely on congressional appropriations.

      Well, I know in Arizona it means no driver's licenses for illegals, kids in this program attending Arizona schools and colleges pay out-of-state tuition rates, and in general they get treated as illegally here.

          Another interesting point is......

          The Army just started enlisting DACA people under the MAVNI program. As soon as they finish AIT, they become Citizens.
          "I don't discuss sitting presidents," Mattis tells NPR in an interview. "I believe that you owe a period of quiet."

            Let's hope it works. Personally, I want to see them complete their term of service honorably before handing over the keys to the nation.

            Completing AIT does not even make one a soldier, merely a trained recruit who is now ready to begin the serious learning process of becoming a real "soldier".


            Too many short cuts in the Obama world, and not enough responsibility or law.

              The thing nobody looks at however, is the miniscule number of "useful" illegals this program really benefits. The number of DACA students in college is tiny. I'm sure the number signing up for military service is small too.
              One way to tell is that nobody releases the numbers involved. On the other hand, the overall number of DACA illegals is released because it is substantial.

              That is, for every useful / productive DACA illegal there are a dozen or more useless / unproductive ones signing up.

                They need to do a better job keeping track of those in the DACA program. We recently had a guy arrested for molesting children.

                SAN JOSE (KCBS) — The San Jose science camp counselor charged with child molestation had been the focus of a federal investigation into child exploitation months before his arrest – and was able to kept his work permit issued through a program for immigrants brought illegally into the country despite the probe, a U.S. senator alleged.

                Edgar Covarrubias-Padilla was arrested May 7th on child pornography charges and days later was charged with child molestation. The 27-year-old was a counselor known as ‘Papa Bear’ at Walden West Science Camp for fifth- and sixth-grade students in unincorporated Saratoga.

                On Thursday, U.S. Senator Charles Grassley (R-Iowa) demanded to know whether administrators of the Deferred Action for Childhood Arrivals (DACA) program – allowing undocumented children brought to the U.S. to avoid deportation and retain a work permit – knew of the criminal investigation. According to Grassley’s office, a whistleblower alerted the senator about the investigation.

                    They doubled the cap when the Administration opened MAVNI up to DACA. There is a lot of DACA traffic on the FB MAVNI page. It is a quick way to get citizenship and green cards for the family. If the Soldier gets accompanied orders overseas.....the spouse gets expedited citizenship also.

                      However, one must note that the "protesters" are primarily a tiny group of ones that are on permanent protest status for open borders, ending immigration enforcement, and that sort of thing.
                      Their protest at this border checkpoint is nothing new. And the couple of dozen protesters that were there are meaningless in the scheme of things.

                      My question to them would be, "If you are against these checkpoints then why aren't you doing more to help end illegal immigration? After all, if there wasn't a mass of illegal immigrants coming into the US there'd be no need for these checkpoints..."

                      Of course, that would get you a string of ad hominem profanities flung back for an answer...
